Terms of Use

1. Agreement to Terms

By downloading, installing, or using the Fish Log mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Fish Log Co. ("Fish Log," "we," "us," or "our"). Please read them carefully.

2. Eligibility

You must be at least 13 years old to use Fish Log. If you are between 13 and 17, a parent or guardian must agree to these Terms on your behalf. The Rewards Member program and quarterly rewards drawings are open only to legal residents of North Carolina who are 18 years of age or older.

3. Accounts & Registration

You may use Fish Log to submit harvest reports without creating an account. To access additional features such as the rewards program, community catch feed, and fishing history tracking, you must register as a Rewards Member by providing a valid email address.

You are responsible for:

• Providing accurate and current information during registration.
• Maintaining the security of your account and email.
• All activities that occur under your account.
• Notifying us promptly of any unauthorized use of your account.

We authenticate Rewards Members via passwordless magic link email. You must have access to the email address you registered with in order to sign in.

4. Harvest Reporting

You are solely responsible for the accuracy of your harvest reports. Fish Log provides a convenient tool to help you submit reports to the NC Division of Marine Fisheries, but we do not independently verify catch information, fish measurements, species identification, or regulatory compliance.

Important disclaimers regarding harvest reporting:

• Fish Log does not guarantee that your report was successfully received by NC DMF. Always verify using the confirmation number provided.
• Fish Log is not a substitute for knowing and following current NC fishing regulations. Always consult official sources at deq.nc.gov.
• Submitting false or fraudulent harvest reports may violate North Carolina law.
• Reports submitted through Fish Log may be used by NC DMF for fisheries management and enforcement purposes.

5. Rewards Program

Fish Log operates a quarterly rewards program for eligible Rewards Members. By participating, you agree to the following:

• Eligibility: Open to legal residents of North Carolina, 18 years of age or older, who are registered Rewards Members.
• Earning entries: Entries are earned by submitting valid harvest reports through the App during the active drawing period.
• No purchase necessary: No purchase or harvest report is necessary to enter or win. Alternative free entry is available by visiting the entry page or by emailing fishlogco@gmail.com.
• Winner selection: Winners are selected randomly from all eligible entries. Winners will be notified by email.
• Disqualification: We reserve the right to disqualify entries we determine to be fraudulent, abusive, or submitted in bad faith.
• Prizes: Prize details, quantities, and values are specified in the drawing configuration for each quarter and are subject to change.

6. User Content & Community Feed

You retain ownership of all content you submit to Fish Log, including photos, catch data, and feedback. By submitting content, you grant Fish Log a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content within the App and related services (such as the community catch feed).

If you are a Rewards Member, your catches may appear in the community catch feed visible to other users. The catch feed displays your first name and last initial, species caught, fish counts, lengths, and any photos you uploaded. Anonymous users' reports are never displayed in the feed.

You agree not to submit content that:

• Is false, misleading, or fraudulent.
• Is illegal, harmful, threatening, abusive, or harassing.
• Infringes on the intellectual property rights of others.
• Contains viruses, malware, or other harmful code.
• Violates the privacy of any third party.

We reserve the right to remove any content that violates these Terms, without prior notice.

7. Intellectual Property

The Fish Log App, including its design, code, graphics, logos, icons, and text, is the property of Fish Log Co. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

Fish Log is built using open-source software. Attributions and license information for open-source components are available within the App under Licenses.

8. Prohibited Conduct

When using Fish Log, you agree not to:

• Submit false, fraudulent, or intentionally inaccurate harvest reports.
• Create multiple accounts to gain additional rewards entries.
• Attempt to access other users' data or accounts.
• Reverse engineer, decompile, or disassemble the App.
• Use the App for any purpose that is illegal under applicable law.
• Interfere with or disrupt the App's servers, networks, or services.
• Scrape, harvest, or collect data from the App by automated means.
• Impersonate any person or entity, or misrepresent your affiliation.

9. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free.
• Harvest reports will be successfully transmitted to or accepted by NC DMF.
• Fishing regulations, species information, or other content in the App is accurate or current.
• The App will be compatible with all devices or operating system versions.

Fish Log is not affiliated with, endorsed by, or operated by the NC Division of Marine Fisheries, the NC Department of Environmental Quality, or any government agency.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FISH LOG CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, FINES, PENALTIES, OR REGULATORY CONSEQUENCES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

This limitation applies regardless of the legal theory on which the claim is based, even if we have been advised of the possibility of such damages. Our total cumulative liability to you shall not exceed fifty U.S. dollars ($50.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless Fish Log Co. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any law or the rights of any third party.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in North Carolina.

13. Changes to These Terms

We may revise these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the App after revised Terms are posted constitutes your acceptance of the changes.

For material changes that significantly affect your rights, we will make reasonable efforts to provide notice through the App or by email.
